  •                                                 Yacht Charters terms & conditions :


    1. Your contract to charter a boat

    These are the terms & conditions for booking Yacht Charters and come into effect once we have received your initial payment or payment in full and confirmed your booking.

    From that time a contract fixing the price and terms exist between you, the charterer and the yachts operator/owner/owners agent, as detailed on the booking invoice for whom Bali Villa and Yacht act as agents.

    On making your booking, you guarantee that you have the authority to and do accept on behalf of your crew the terms of these booking conditions.

    Once your booking form and payment has been received, you will receive confirmation of your booking within maximum 5 days. You should check the details of your confirmation carefully to ensure that it accurately reflects the booking you have requested and should inform us immediately of any discrepancies. This contract is agreed on the terms of these booking conditions, which are governed by Indonesian law, and we both agree to submit to the jurisdiction of Indonesian courts at all times.


    2. Price and payment

    *Booking a boat at least maximum four weeks in advance.

    If you make a booking four or more weeks before the first day of your charter, an initial payment of 50% of the price of the yacht charter is required within four days of you making the booking. If, for whatever reason, we do not receive cleared funds within these time frames, your booking will be cancelled and we will inform you of this.

    The remaining 50% of the price of your charter will be payable not later than one weeks before the first day of your charter.

    *Booking a boat within four weeks of the departure date

    If you make a booking four weeks or less from the first day of your charter, payment for the full price of your charter is due within four days of you making the booking. If, for whatever reason, payment is not received within this timeframe your booking will be cancelled and you will be informed of this.

    Once you have booked, as per article 1 of this contract, the agreed price of your sailing holiday is fully guaranteed by your charter operator and will not be subjected to any surcharge. This does not apply to possible invoice, typing or other errors.

    *Payment Method

    The payment should be made 50 % by wire transfer and balance should pay 4 days before arrival in Indonesia.

    This deposit is not refundable.Deposit and Payment:

    Additional Terms and Conditions

    PRIVATE VILLAS AND YACHTS,contact as an agent of service providers that may have own terms and conditions other than aforementioned here. Therefore, additional terms and conditions shall be applicable whenever necessary and you are agreeing to bear such terms and conditions.


    3. If you want to change your booking details

    If you want to change the details of your holiday once the contract has been entered into (as per article 1 ) – for example, if you want to change the departure dates or the boat model – then you should contact us, via Private Villas and Yachts by phone or e-mail, and we will endeavor to make these changes, but are not obliged to do so, as it may not always be possible. Only you, the signatory to this contract, are authorised to contact us in this respect. Surcharges, if any, stemming from such changes will be quoted individually once we have established whether the changes you want are possible. If you request major changes (for example, the same boat but a different departure port) within three weeks of the departure date, we reserve the right to treat such a request as a cancellation of your original holiday and the booking of a new holiday, whereby you may forfeit your original deposit (see below).


    4. If you cancel your holiday

    To cancel a reservation (“Cancellation”), the Hirer should notify the Our Company in writing. If the Cancellation is received by the Our Company sixty days or more prior to departure, either (i) a Nine Hundred Dollar penalty shall be assessed or (ii) the charter dates may be rescheduled for an administration fee. If the Cancellation is received by the Our Company between thirty-nine and twenty days prior to departure, either (i) the Deposit shall be forfeited. The Company reserves the right to treat Changes as Cancellations in accordance with the terms of this Paragraph 


    5. If we change or cancel your holiday

    The arrangements for sailing holidays are made many months in advance and it is inevitable that changes will sometimes become necessary. We reserve the right to make such changes if they do become necessary.

    Most of these changes will be minor and we will advise you of them as soon as possible. We also reserve the right to cancel this contract or to suggest major changes due to unexpected circumstances (e.g. damage caused by freak weather conditions etc.).

    Force Majeure: We will not pay you compensation if we have to cancel or change your sailing holiday in any way because of war, riot, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions or other unforeseen circumstances that may amount to force majeure.

    If we are forced to make a major change to your sailing holiday, we will inform you as soon as reasonably possible and offer you, an alternative arrangement if there is time before your departure. In most cases, we shall offer an alternative, which is the same price, or more expensive (on our price list) than the charter you originally booked. If an alternative suggested by us is cheaper, you are entitled to a refund of the price difference.


    6. Sailing holiday termination

    We reserve the right at our absolute discretion to terminate without further notice the holiday arrangements of any client who refuses to comply with the instructions or orders of our staff or other responsible person and whose behavior in the opinion of these people is likely to cause distress, damage, danger or annoyance to other customers, staff, third party or property. Upon such termination, our responsibility for your holiday ceases and we shall not be liable for any extra costs incurred by you.


    7. If you have a complaint

    If you have a problem during your holiday, please inform a relevant member of our charter operators staff immediately, who will endeavor to put things right. If your complaint is not resolved locally, please advise Private Villas and Yachts before the end of your charter and follow this up within 28 days of your return home by writing. It is strongly suggested that you communicate any problem to us immediately and complete a report whilst in our marina. If you fail to follow this simple procedure, we will have been deprived of the opportunity to investigate and rectify your complaint whilst you were on holiday and this may affect your rights under this contract.


    8. Marine insurance for your charter boat

    All yachts are comprehensively insured. Their policy provides full cover for the equipment and tender. We cannot be held responsible for any loss that you may suffer as a result of the insurers failing to indemnify any risk through you providing incorrect or incomplete information of previous sailing experience.

    We strongly recommend that you take out personal travel insurance to cover personal injury, loss or damage to personal effects and cancellation or curtailment.

    A refundable security deposit must be paid to the operator on the spot once you and our staff have checked the boat. This is paid in the form of a signed credit card slip, cash or travelers cheques, which is held until you return the boat. The amount is determined by the size of yacht and is displayed on your online booking form. A refundable deposit may also be required for tenders, outboards and GPS, which will be forfeited in the case of loss or damage to this equipment. However, should damage or loss be caused as a result of willful damage by a client, a client under the influence of alcohol or drugs or as a result of not obeying our staff’s instructions, then he or she will be liable for the full amount of repair or replacement. Adults will at all times be responsible for minors in their charge.


    9. Restrictions

    Neither the yachts operators, or Private Villas and Yachts are responsible for you and crew’s safety afloat. We not responsible for any damage caused by your sailing and staying on a chartered boat.


    10. Conditions of travel arrangements

    The contractual terms of companies providing travel services to and from yachts are in no way related to these terms & conditions.


    11. Briefing our crew

    We must acquaint the members of our crew with the conditions of this contract and make sure they understand their obligations as stipulated under this contract.

  •                                                        Villa Rental Terms & Conditions :

    RESERVATION PROCEDURES
    1. Reservation must be made in writing, either by filling out the reservation form available on our website or contact us via email:

    2. Please provide detailed information the number of members who will come, their nationality, and their ages, including children and babies.

    3. Our reservation will respond to your inquiry at the latest within 24 hours. If you do not receive response after 24 hours, please contact us immediately via the following email address: 

    4. You will receive detailed information about the villa, the price for the lease period, and further instructions to complete your reservation.

    5. Availability may change from time to time, especially in peak and high season. The villa which is available when our reservations responds your inquiry may no longer available when you decide to confirm the reservation. It is therefore advisable to confirm your reservation as soon as you receive availability information.

    6. As soon as you confirm your reservation, our reservation will issue an invoice with detailed payment instructions.

    7. Be sure to complete the payment before the due date. Your reservation will be automatically released if you fail to make payments before the due date.

    8. When we receive the payment, we will issue a payment receipt along with the booking confirmation contains information related to your reservation, including check-in and check-out, the remaining payments, etc.

    9. To pick up the proper settings, please provide a detailed schedule of the arrival of each member of your group.

    PAYMENT METHODS :
    There are 2 (two) payment methods as below:
    You can choose one of the two options below to settle your payment.
    1. Bank transfer :
    Transfers are made to our bank account as informed in our invoice.
    All costs related to the transaction have to be borne by you. Make sure to mention “Full Amount Guarantee” when you  submit the transfer instruction.
    2. Online payment.
    Payment via PayPal
    Payment can be made to our PayPal company account.

    ARRIVAL
    1. Our officer will be waiting for you at the arrival gate, holding a board with your name.
    2. Check in time is 14.00 and check out time is 11.00. Early check in and late check out can be arranged based on availability. Requirement for early check in and/or late check out should be communicated in advance.
    3. Late check out until 18.00 will be charged at 50% of one night rental rate.

    CANCELLATION
    1. Cancellation has to be made in writing, either by email or fax.
    2. No show is subject to forfeiture of all payments you have made.

    LIABILITY
    Getting travel insurance which covers any potential disadvantages during your holiday including illness, injury, death, damage, loss, and cancellations is highly advisable.
    1. Private Villas and Yachts is not liable to damage, loss, injury, and death sustained by residing clients both inside and outside the villa.
    2. Whilst we make our best effort to ensure accuracy of information presented in our website, we are not responsible for any changes and alterations made by the villa owner.
    3. Private Villas and Yachts is not responsible and therefore is not liable to borne any related expenses caused by inconvenience caused by condition of the villa.
    4. Private Villas and Yachts is not liable to any loss and damages to personal belongings of the clients and their visiting guests including cars and personal belongings left inside.

    LOSSES and DAMAGES
    1. Clients are responsible to leave the villa in good order and clean condition.
    2. Clients are liable to cover any losses and damages to the villa during their occupation.
    3. Villa owner retains the right to repossess the villa if the clients or their guests cause damages to the villa.

    COMPLAINS and FORCE MAJEUR
    Means any unusual and unforeseeable circumstances beyond our normal control, which the consequences of could not have been avoided even when exercising all due care. Such circumstances or events include, but are not limited to, war, or threat of war, riot, civil unrest, industrial disputes or strikes, unavoidable technical problems with the villa, transport, or closure or congestion of airports, terrorist activity, natural disasters, industrial disasters, fire, theft, flooding and adverse weather conditions. In the event of any of the above refunds or compensation payments cannot be made.
    Private Villas and Yachts and Villa owners are doing their best to provide comfortable accommodation for the clients to occupy. However we are also aware that there are issues beyond our control which may negatively affect client’s experience.
    Clients have to address complains to the villa manager immediately.
    Villa owner and Private Villas and Yachts will not entertain any complains raised after client’s departure.

    GENERAL
    1. All clients are strongly recommended to obtain appropriate travel and medical insurances.
    2. Clients are responsible to ensure that every member of their group has proper travel document as regulated by the government of the Republic of Indonesia.
    3. Private Villas and Yachts is not liable to refund any losses caused by improper documentation and any other travel related problem including but not limited to cancelled or delayed flights.
    4. Private Villas and Yachts is not liable to any illegal conduct or actions against the law of the Republic of Indonesia.
